In the legal proceedings regarding the 2011 murder of Yara Gambirasio, defense attorney Claudio Salvagni requested new DNA comparisons to challenge the conviction of Massimo Bossetti. The defense proposed comparing mitochondrial DNA found on the victim with that of Moussa Sangare, suggesting that unidentified hair samples and geographical proximity indicated the involvement of a third party. The defense also raised concerns regarding the destruction of previously thawed DNA samples. Subsequently, the Court of Assize of Bergamo rejected these requests for new forensic analyses. The court addressed challenges to the methodology used for sample ‘31G20’ and questions regarding unidentified genetic traces on the victim’s clothing. In its ruling, the court maintained that the genetic profile ‘Ignoto 1’ was derived from multiple samples rather than just one, noting that several samples from the victim’s clothing yielded the profile attributed to Bossetti. Specifically, judges noted that 16 out of 52 samples from the victim’s underwear and two out of 12 samples from her leggings yielded the profile. The court concluded that existing data did not justify further testing, as new analyses were unlikely to provide grounds for revising the sentence. Following the court's decision, Nicolas Bossetti, the son of the convicted man, spoke publicly in a television interview on Rai 2. He characterized the case as “the most significant judicial error in Italian history,” alleging that his father was denied fundamental rights, such as the ability to properly review primary DNA evidence. Supported by defense counsel, Nicolas continues to call for a re-analysis of DNA traces found on the victim's jacket, maintaining that his father is innocent and the true perpetrator remains at large. More recently, the Court of Cassation rejected a seventy-page appeal submitted by lawyers Claudio Salvagni and Paolo Camporini.
