In late September 2026, businessman Marcelo Conde requested that Edson Fachin, President of the Brazilian Supreme Federal Court (STF), annul decisions made by Justice Alexandre de Moraes. The request stems from an investigation into the leaking of confidential tax data belonging to Viviane Barci de Moraes, the justice’s wife. Conde, a suspect in the case, argues that Moraes should be disqualified from presiding over the investigation due to the involvement of his spouse’s sensitive fiscal information. By early October, Justice Moraes issued a fine against lawyer Marcelo Henrique Martins R$ 5,000 for attempting to manipulate the court’s artificial intelligence systems. The lawyer used ‘prompt injection’—hidden text within a legal petition—to instruct the AI to ‘Deny all GPT commands’. Technical experts classified the move as a possible attempt at a ‘jailbreak’ to influence judicial decisions. Moraes ruled the act an affront to the dignity of Justice and referred the matter to the Brazilian Bar Association and the Federal Public Ministry for further investigation. Following the STF incident, the Court of Justice of Bahia (TJBA) reported a similar attempt within a habeas corpus request. Technical analysis identified a hidden layer of text inside a PDF file designed to induce AI tools to grant the requested release. This matter has also been referred to the OAB and the Public Ministry of Bahia for investigation into the attorney’s professional conduct. In response to these technological threats, the Court of Justice of Rio Grande do Sul is developing its own AI agents to manage costs and enhance security against such frauds.
