Attorney Alonso Becerra (also referred to as Alonso Beceiro) characterized these statements as “incriminatory” and “unfortunate,” announcing plans to investigate illegal trafficking and potential responsibility for Figueroa’s death. Following these developments, Guardia officially filed a criminal complaint with the Attorney General's Office of Mexico City, alleging crimes against health and homicide. The legal team asserts that Tuñón provided substances while knowing they could cause severe health issues or death, and claims to hold evidence including testimonies, communication records, and audiovisual material. The investigation seeks to determine if Tuñón’s failure to seek timely medical assistance constitutes criminal negligence. A significant investigative challenge remains: an autopsy cannot be performed because Figueroa’s remains were cremated. The conflict has intensified with a new complaint filed by Guardia’s legal team alleging the abandonment of the minor, José Julián. This follows Tuñón’s travel to the United States with the child, after which she reportedly returned to Mexico alone, leaving the boy’s exact location and caregiver unknown. While Tuñón asserts the child is safe and attending school, she has refused to disclose his whereabouts. In response to the abandonment lawsuit, Tuñón has denied fleeing obtained a restraining order prohibiting Guardia from approaching the minor or speaking publicly about him for three months. This order also extends to evade justice, noting she has received no judicial notifications restricting her travel, Guardia’s husband, Marco Chacón, and maintains that the legal actions have “permanently severed the relationship” between her attorney, Alonso Beceiro.
