The 13th Panel of the Federal Regional Court of the 1st Region (TRF-1) has unanimously authorized the family of former Brazilian President Tancredo Neves to access confidential medical documents regarding his treatment prior to his death in April 1985. The ruling requires the Federal Council of Medicine (CFM) and the Regional Medical Council of the Federal District (CRM-DF) to provide documentation concerning the care Neves received medical files, lists of involved professionals, and other treatment records from his hospitalization at the Hospital de Base in Brasília. This decision reverses previous rulings that had upheld medical confidentiality. The legal action, initiated by Neves’s son, Tancredo Augusto Tolentino Neves, seeks to clarify the medical circumstances surrounding the death of the president-elect during Brazil’s transition to democracy. The family and researchers aim to investigate allegations of medical error or negligence. Such suspicions were previously highlighted in the book ‘O Paciente: O Caso Tancredo Neves’, which noted irregularities such as the presence of over 30 people in the operating room and questionable post-operative care. While medical councils argued that professional secrecy is permanent, the court determined that medical confidentiality is not absolute. Judge Roberto Carvalho Veloso stated that the “right to information and the preservation of national historical memory” justify the release, serving the interests of both the family and Brazilian society. The family intends to use the records to support research for a book titled ‘O Paciente: O Caso Tancredo Neves’ and to analyze the circumstances of his death, which was officially recorded as a generalized infection.
