Lithuanian Labour Code amendments and market updates
Overview
Lithuania is implementing significant amendments to its Labour Code to update employment regulations. While legislative debates continue regarding the protection of digital platform workers—aiming to transpose EU directives and regulate algorithmic management—new provisions regarding contract terms are set to take effect on November 1, 2026.
Effective November 1, employers may agree to probationary periods of up to six months for employees earning at least two times the average monthly gross wage (VDU), an increase from the previous three-month maximum. This period excludes time spent on leave or temporary incapacity for work. The amendments also introduce greater flexibility regarding notice periods and establish a new ground for termination: when an employee fails to meet legally established “impeccable reputation requirements,” particularly in regulated sectors. Additionally, certain previous prohibitions against terminating contracts under specific conditions are being removed.
Regarding digital platform workers, the Lithuanian Seimas is debating measures to prevent the misclassification of employees as independent contractors. These proposed changes would grant workers the right to request explanations for automated decisions and demand human reviews for critical actions, such as account blocking or dismissals.
Concurrently, the Lithuanian labor market has shown recent volatility and growth. The Employment Service reported a significant surge in activity in September 2026, noting the highest increase in people returning to work in the last twelve months. Approximately 23,000 clients began working in September, representing a 37.1% increase from August, with the highest influx appearing in the education, accommodation, food services, and healthcare sectors.
