Maine immigration and law enforcement policy disputes

In Maine, new legislation took effect on July 29 that restricts local law enforcement from inquiring about immigration status or sharing personal information with U.S. Immigration and Customs Enforcement (ICE) and U.S. Customs and Border Protection (CBP). While exceptions exist for state or federal criminal investigations, such as terrorism or human trafficking, jail staff are prohibited from honoring ICE hold requests for civil detention purposes. Law enforcement officials have raised concerns regarding limited access to Department of Homeland Security resources, while advocates argue the law prevents the misuse of local resources.

Following this, Republican gubernatorial candidate Bobby Charles proposed involving federal law enforcement at polling locations during the November election. Charles stated he intends to request that the border czar deploy ICE agents and federal marshals to voting booths. Critics have noted that 18 U.S. Code § 592 prohibits sending armed personnel to polling places except to repel armed enemies, and Democratic candidate Hannah Pingree accused the proposal of attempting to interfere with free and fair elections.

U.S. Senator Susan Collins has since expressed opposition to Charles’s plan. During a visit to Biddeford, Collins stated she does not “see the need” for an ICE presence on Election Day, warning that such a presence could “intimidate a lot of legitimate American voters” and make them “very uncomfortable.” While Charles’s campaign manager, Dale Crafts Jr., defended the stance as a means to ensure elections are decided by legal voters, Maine Secretary of State Shenna Bellows and other critics have noted that state law prohibits law enforcement within 250 feet of voting locations.
