Court modifies Mangalia shipyard sale procedure

Overview

The Mangalia Naval Shipyard in Romania continues to face significant financial and operational hurdles during its insolvency process. A third attempt to auction the facility failed to attract any bidders, as the starting price of approximately 184 million euros remained significantly higher than the shipyard’s liquidation value of roughly 84 million euros.

On September 4, the Constanța Tribunal issued a ruling that modifies the sale procedure. Under this new court-approved framework, the liquidator, CITR, may organize new auctions starting at the current market value. If no offers are received, the price may be gradually reduced in subsequent rounds. Additionally, the court approved the sale of the functional asset as a single block rather than in pieces, following the rules of public auction within forced execution procedures as outlined in the Civil Procedure Code.

The shipyard’s financial situation remains critical, with reported debts now exceeding 2.1 billion lei. This includes significant arrears to the Romanian tax authority (ANAF) and employees. There are growing concerns that the asset could eventually be sold for a price lower than the value of its existing machinery, a scenario drawing comparisons to previous industrial liquidations in Romania.
