Marbella transgender woman murder investigation

Overview

Following the murder of Franyel, a 35-year-old Venezuelan transgender woman, in Marbella, Spain, advocacy groups are demanding the killing be officially classified as gender-based violence. The victim was killed by her partner, a 59-year-old man who has been detained and placed in provisional prison.

The Asociación Trans española de Andalucía-Sylvia Rivera (ATA) and the Asociación Pro Derechos Humanos de Andalucía (APDHA) have petitioned the government and judiciary to ensure the case is handled by specialized courts for violence against women. Currently, the investigation is being managed by a general instruction court.

Activists argue that administrative delays in implementing the Trans Law (Law 4/2023) have left migrant transgender women vulnerable. They contend that because Franyel had not yet updated her identity in the Civil Registry, there is a risk that judicial authorities might use documentary discrepancies to deny her identity as a woman and, consequently, deny the classification of the murder as gender-based violence.
