A federal judge in Chicago has allowed a proposed class action lawsuit against McDonald’s to proceed. The lawsuit, filed by four consumers, alleges that the company misled customers regarding the ingredients in its McRib sandwich. Plaintiffs claim the product’s name and ridged shape create a false impression that the sandwich contains expensive rib meat, when it allegedly utilizes lower grade pork cuts such as shoulder, heart, tripe, or stomach. To support the allegations of fraud, deception, and unjust enrichment, the plaintiffs cited surveys suggesting a majority of consumers expected the sandwich to contain rib meat. McDonald’s U.S. District Judge April Perry rejected the company’s attempt to dismiss these central claims, though five other claims were dismissed without prejudice. Mcdonald’s has denied the allegations, maintaining that the McRib is made from 100 percent pork sourced from American farmers and suppliers. The company specifically denied using heart, tripe, or scalded stomach in the product, arguing that its marketing is truthful. While the judge dismissed five other claims, truthful and that the central allegations regarding consumer deception are permitted to move forward. name and presentation do not mislead a reasonable consumer.
