Medical malpractice legal proceedings in Italy

Overview

Legal actions regarding medical malpractice and patient deaths have emerged in different Italian jurisdictions.

In one case, three dentists—including a practice owner and his two daughters—are scheduled to face trial for manslaughter following the 2024 death of 23-year-old Gaia Pagliuca. Prosecutors allege the death resulted from an anesthetic overdose and inadequate emergency resuscitation efforts during a routine procedure.

In a separate matter, the Court of Torre Annunziata issued convictions against three medical professionals involved in the 2022 death of 37-year-old Vanessa Cella. The victim died following consecutive cosmetic procedures at the Santa Maria la Bruna clinic. The court found the defendants responsible for issues involving anesthetic amounts, the use of curare, and failures in post-operative monitoring. Sentences were issued to the surgeon, the anesthesiologist, and the clinic’s medical director, with additional investigations into the clinic’s management requested by the public prosecutor.
