Mississippi DEI legislation legal challenges

Overview

The U.S. Fifth Circuit Court of Appeals has vacated a preliminary injunction that was blocking portions of Mississippi House Bill 1193. This law restricts diversity, equity, and inclusion (DEI) programs, offices, and courses within public schools, community colleges, and universities. It further prohibits the discussion of certain “divisive concepts” related to race, gender identity, religion, and national origin, with institutions facing the potential loss of state funding for violations.

The court’s decision follows a previous ruling by U.S. District Judge Henry T. Wingate, which the appeals court criticized for containing errors, including fabricated parties, quotations, and a nonexistent case. The court noted that a law clerk had used the AI tool Perplexity during the preparation of an early draft that was mistakenly docketed.

As a result of the ruling, the case has been reassigned to a different federal judge. While the Fifth Circuit did not rule on the constitutionality of the law, it clarified that the restrictions do not apply to scholarly activities, creative engagements, or specific historical discussions regarding civil rights and the Ku Klux Klan. Plaintiffs, including educators and activists, have several weeks to petition for a rehearing.
