Montana legislative term limit legal dispute

A legal dispute has emerged in Montana regarding the interpretation of state term limit laws. Attorney General Austin Knudsen issued a ruling stating that lawmakers are limited to eight years in a single chamber within a 16-year period, requiring candidates to wait a full election cycle if they exceed these limits. This decision departs from previous interpretations that allowed lawmakers to move between chambers without interruption.

The ruling has caused immediate electoral consequences. House Majority Leader Steve Fitzpatrick announced plans to file a lawsuit to remain on the ballot, describing the decision as an “affront to democracy.”

In Senate District 9, a 12-member subcommittee of the Montana Republican Party voted to replace Representative Llew Jones on the ballot with Ted Kronebusch, a retired businessman. The replacement follows the legal opinion suggesting Jones is ineligible for the state Senate this cycle. While the legal challenge moves through the courts, the situation remains uncertain as the deadline for the November ballot approaches.
