Montenegro is facing legal and administrative challenges regarding its judicial system. Following a ruling by the European Court of Human Rights, the state is required to pay Saša Boreta 1,620 euros in non-material damages and 250 euros in legal costs due to excessive judicial delays. The Constitutional Court of Montenegro took over five years to process Boreta’s case, mirroring similar rulings in the cases of ‘Madras CO d. o. o. Ljubljana v. Montenegro’ and ‘Uruçi v. Montenegro’. In response to To address judicial needs, the Ministry of Justice has drafted a law to increase court fees by up to 50 percent, marking the first update to tariffs in two decades. since 2005. The proposal aims to align fees with inflation, improve fee collection, reduce administrative burdens, and increase efficiency. The draft includes new introduces specific fees for misdemeanor proceedings proceedings, such as 37 euros for certain requests and 15 euros for appeals or requests for restoration to a previous state. It also establishes mechanisms a more precise mechanism for the compulsory collection of unpaid debts to increase state budget revenues. However, the proposal has met resistance from legal professionals. Attorney Veselin Radulović argued that the increase does not address the underlying issue of insufficient collection of existing fees and warned that high costs and strict payment deadlines could act as a deterrent, “discouraging citizens from initiating legal proceedings to protect their rights.” Attorney Saša Vujović also emphasized that judicial funding should not serve as a barrier to citizens seeking legal protection.
