Mount Cristo Rey border wall dispute

Entities: Veronica Escobar · Trump administration · Diocese of Las Cruces · U.S. District Court for the District of New Mexico · Mount Cristo Rey

Overview

The Diocese of Las Cruces continues to contest the federal government’s effort to seize roughly 14 acres of Mount Cristo Rey for a border‑wall project. After filing a request for a jury trial in early July, the diocese argued the taking would violate the First Amendment and the Religious Freedom Restoration Act, and warned the wall would deface a 29‑foot limestone statue of Christ and restrict access to the shrine.

On 22 July a federal judge postponed the eminent‑domain hearing scheduled for 23 July, moving it to mid‑September. The delay gave both sides more time to present arguments.

On 27 July the Trump administration formally filed an eminent‑domain lawsuit to seize the 14‑plus acres, including the 4,675‑foot peak and statue. The diocese reiterated its constitutional challenges and sought compensation via a jury trial. Representative Veronica Escobar (D‑TX) again introduced the Mt. Cristo Rey Protection Act, which would recognize the site as holy and bar federal funds for any taking. The Church also cited damage to a sacred Indigenous site in Arizona as a precedent of governmental disregard for religious and cultural heritage. The case remains a focal point of the clash between border‑security priorities and constitutional protections for religious practice.
