The Nepal government is advancing the long-delayed Federal Civil Service Bill, which has faced an eight-year stalemate primarily due to a contentious ‘55/30 provision’. This rule would mandate retirement for civil servants upon reaching either 55 years of age or 30 years of service. Implementation of this provision could lead to the immediate mandatory retirement of more than 13,000 employees and increase the state’s financial burden by over Rs 25 billion. Following a Cabinet decision, the bill moved to the Public Service Commission (PSC) for consultation. The proposed legislation includes reforms such as allowing lateral entry for outside experts into specialist positions, adjusting maximum entry ages to 32 for men and 35 for women, and addressing structural reforms regarding political neutrality and performance evaluations. As the current parliamentary session nears its end, the bill faces uncertainty regarding whether it will be passed through Parliament or introduced via an ordinance. The PSC has formally submitted its opinion to the government, objecting to the retirement provision and related pension changes. The PSC concluded that the one-time retirement rule is “inconsistent with the Constitution and existing national and international practices.” While In a recent development, the Ministry of Land Management, Cooperatives, Federal Affairs and General Administration maintains Nepal Cabinet has officially approved the process is moving forward as a bill, some officials suggest preparations Federal Civil Service Bill for an ordinance may be underway. If an ordinance is utilized, submission to the PSC’s recommendations would not be binding, a prospect opposed Federal Parliament. This decision was announced by several senior government officials. spokesperson and Education Minister Sasmita Pokhrel following a Council of Ministers meeting.
