Netherlands competition regulator ACM policy updates
Overview
The Netherlands Authority for Consumers and Markets (ACM) has implemented new measures to strengthen market competition and consumer rights.
In September 2026, the Dutch House of Representatives approved legislation expanding the ACM’s powers to intervene in smaller mergers and acquisitions. This change allows the regulator to investigate deals where combined turnover exceeds 50 million euros, a move intended to prevent market dominance in sectors like healthcare and childcare, and to combat ‘killer acquisitions’ by technology firms.
Following this, in October 2026, the ACM issued new guidance regarding the Data Act to address concentration in the cloud services market. The guidance aims to facilitate easier and more cost-effective switching between cloud providers, reducing customer dependency on the three largest firms. ACM board member Manon Leijten noted that these measures are intended to stimulate competition on price and quality, allowing smaller providers to compete more effectively.
