In late July 2026 Governor Mikie Sherrill accelerated New Jersey’s consumer‑price agenda. After the FAIR Act was signed on July 20, banning algorithmic rent‑setting, she enacted the Fair Price Protection Act two days later, prohibiting retailers from using shoppers’ personal data to set individualized grocery prices and pausing new electronic‑shelf‑label rollouts for a year. Both measures cleared the state Senate and Assembly on June 30 before being signed. The FAIR Act requires rent‑setting platforms to disclose their pricing methods and bars algorithms that could artificially inflate rents, a response to a 2024 DOJ antitrust settlement with RealPage and highlighted by Attorney General Jennifer Davenport. The law targets software used by landlords in a market where rents exceed the national average by more than 20 %. The Fair Price Protection Act blocks AI‑driven “surveillance pricing,” covering most grocery and household items while exempting restaurant‑style establishments; uniform loyalty‑program discounts remain allowed. Maryland’s Protection From Predatory Pricing Act, signed 28 April 2026, and Connecticut’s similar statute took effect 1 October 2026, placing New Jersey’s law in a regional trend. New York already has a transparency law (2025) and a stronger proposal is pending. On July 25 Sherrill issued an executive order directing agencies to catalog hidden “junk” fees and propose elimination measures by mid‑September, targeting families, renters and seniors. Implementation of the Fair Price Protection Act begins August 1 2027, with a one‑year deferral of mandatory electronic‑shelf‑label installation until February 1 2027. New Jersey joins Maryland and Connecticut in restricting AI‑driven pricing, as similar bills are debated in several other states.
