Nova Scotia disability and housing support disputes

In Nova Scotia, legal and administrative developments have highlighted tensions regarding support for vulnerable populations. An independent review by Michael Prince indicated that the provincial government has shown “little urgency” in meeting a 2028 deadline to transition people with disabilities out of institutions, noting that only seven of 34 required actions have been completed.

Simultaneously, a legal dispute regarding income support for those living in tents reached the Nova Scotia Court of Appeal. The court ruled that the province could not deny enhanced income support to tent dwellers, rejecting arguments that such payments might encourage tent living.

Following this ruling, the Nova Scotia government implemented legislative amendments to redefine qualifying housing for income assistance. The new regulations define a “home” as a self-contained unit requiring private living, kitchen, and bathroom facilities, including plumbed water and sanitary sewer disposal. This change effectively excludes individuals living in tents, cars, or trailers from receiving higher assistance rates, a move that follows the legal challenge involving the estate of Bradley Lowe.
