The legal status of former President Pedro Castillo remains a focal point of Peruvian politics. Following his 12 August 2026 appearance before the Second Constitutional Court of Lima to argue a habeas corpus petition, Judge Ana Osorio dismissed the request as “improcedente” (inadmissible). While Castillo’s defense cited a United Nations Working Group on Arbitrary Detention report recommending his release, the judge ruled that the UN report is an “extra-conventional procedure” and not a binding jurisdictional decision for the Peruvian state. During the hearing, Castillo argued that his arrest on 7 December 2022 was conducted outside of legal procedures and that he was never properly notified of the impeachment motion, asserting a violation of the American Convention on Human Rights. He also contested the prosecution's claim of flagrancy, stating no weapons were raised during his national address. In a subsequent ruling, the Constitutional Court rejected habeas corpus petitions filed by Castillo and former Interior Minister Willy Huerta. The court noted that because both are serving sentences related to the failed December 2022 coup attempt, their legal challenges must be addressed through the standard appeals process in the Supreme Court. Regarding Vladimir Cerrón, the founder of the Perú Libre party has resurfaced after nearly three years in hiding. Following the annulment of his preventive detention and the removal of his Interpol warrant, Cerrón claimed he never left the country and asserted he was often within 200 meters of police without being detected. He also confirmed maintaining contact with former interim president José María Balcázar. In a significant development for the Humala family, the National Superior Court annulled the 15-year money laundering conviction against former first lady Nadine Heredia. This follows the Constitutional Court’s 30 July 2026 ruling declaring the criminal process against former President Ollanta Humala null, determining that third-party campaign financing did not constitute a crime in the context of the Odebrecht investigation. The court has ordered the case to be definitively archived and the lifting of international arrest warrants for Heredia.
