Regulations governing Family Allotment Gardens (ROD) in Poland establish strict prohibitions for plot holders. Under the ROD Act, residential living and business activities on allotment plots are forbidden. Garden associations may terminate leases if users reside on plots, conduct business after warnings, destroy infrastructure, disrupt order, or fail to pay fees for six months following written notice. Rules also dictate the placement and dimensions of garden structures. Composters must be placed at least 1 meter from plot boundaries in discreet, shaded areas. Similar distance requirements apply to greenhouses, foil tunnels, and pergolas. Foil tunnels are limited to a maximum height of 3 meters and cannot occupy more than 20 percent of the total plot area. Garden boards maintain the authority to order the dismantling of structures that violate these regulations or are considered unsightly. Legal constraints further clarify that users of ROD plots hold only leasehold rights rather than ownership, as the land remains the property of the municipality or the State Treasury. Consequently, gardeners lack the authority to change land designation for residential purposes. Regarding construction near boundaries, standard regulations require a 3-meter distance from the boundary if walls lack windows or doors, increasing to 4 meters if openings are present. However, certain exceptions under local spatial management plans may allow utility buildings or garages up to 6.5 meters long and 3 meters high to be placed closer to the boundary.
