Poland groundwater regulation and compliance

Wody Polskie has intensified inspections of groundwater intakes to combat illegal extraction, a problem worsened by droughts. Regulations mandate water law permits for wells deeper than 30 meters or those exceeding 5 cubic meters of daily consumption. Non-compliance has resulted in significant penalties, with fines exceeding 14 million PLN between 2025 and 2026. Authorities aimed to increase the proportion of groundwater-related inspections to 25 percent in 2026.

In response to these regulatory pressures, an amendment to the Water Law became effective on August 18, 2026. This amendment introduced a temporary amnesty for owners of groundwater extraction devices that were constructed without the necessary permits or notifications. This amnesty allows owners to regularize their legal status without paying the standard 6,601.67 PLN legalization fee and may exempt them from certain administrative fines. However, the amnesty is limited to the illegal construction of devices and does not cover the unauthorized extraction of water itself.

Additionally, new guidelines established consumption norms for residential properties lacking main water meters, with rates determined by whether a property is connected to a sewage network or uses a septic tank.
