Polish family law and privacy reforms

Poland is undergoing developments in its family law and administrative procedures. New regulations are being introduced to update marriage-related documentation to better recognize unions established abroad.

Legislative efforts are also targeting digital privacy, specifically addressing ‘sharenting’. Proposed reforms would mandate that parents protect their children’s privacy online. In instances of ‘parental trolling’—where a child is exposed to danger or ridicule—courts may have the authority to limit or revoke parental rights. Additionally, individuals reaching age 16 will gain the exclusive right to control the publication of their own image.

Existing legal frameworks also govern divorce and inheritance. In divorce proceedings involving minors, courts prioritize the child’s best interests when regulating parental authority and maintenance. Regarding inheritance, the Civil Code provides children with a statutory share, known as ‘zachowek’, which remains enforceable unless specific legal prerequisites for disinheritance are strictly met within a will.
