Polish legislative reforms on debt and restructuring

The Polish government has introduced several legislative reforms targeting debt management and financial restructuring. Initially, the government adopted new bankruptcy and insurance restructuring laws designed to implement EU directives. These reforms include a system for the controlled rescue of insolvent insurance and reinsurance companies under the supervision of the Polish Financial Supervision Authority (KNF) to protect policyholders. Additionally, new provisions for consumer and individual entrepreneur bankruptcy aim to simplify debt relief processes and accelerate the discharge of obligations.

Following these financial reforms, the government proposed changes to housing cooperative regulations in response to rising housing debt. The proposed reforms include administrative updates such as fixed terms for management boards and remote participation in meetings. However, the legislation also introduces stricter measures for debtors, potentially allowing cooperatives to seek termination of premises rights through court if fees remain unpaid for at least six months. This move seeks to remove existing protections that previously allowed tenants to prevent termination by paying arrears before a court ruling, addressing significant outstanding payments reported in the housing sector.
