Legal challenges regarding parliamentary immunity have emerged involving different Polish officials. In Tarnów, Member of Parliament Robert Wardzała of the Civic Coalition invoked his immunity during a police stop after officers reported detecting the odor of alcohol while he was cycling without required lighting. Police noted that because the incident involved a misdemeanor rather than a crime, they lacked the authority to force a sobriety test. Małopolska police have announced plans to request that the Marshal of the Sejm lift Wardzała’s immunity to allow for accountability regarding the misdemeanor. Separately, Prosecutor General Waldemar Żurek has formally requested that the President of the European Parliament waive the immunity of MEP Daniel Obajtek. The request seeks authorization for arrest and pretrial detention following an investigation into Obajtek’s former role as CEO of Orlen. Prosecutors allege that in October 2023, Obajtek directed employees to artificially cap fuel prices in 2023, an action they claim bypassed procedures and at PLN 5.99 per litre for non-economic reasons, bypassing established procedures. The prosecutor’s office claims these actions caused fuel shortages at over 600 service stations and resulted in damages exceeding PLN 4.1 billion. The offenses cited could carry a prison sentence of up to 25 years. Obajtek, a representative of the Law and Justice party, has challenged the motivations of the legal action.
