Portland business owner lawsuit regarding shooting
Overview
In March 2023, Kenneth Voyles, who was homeless at the time, broke into Touchstone Granite & Marble in Portland. During the incident, business owner James Grant shot Voyles three times. Voyles subsequently filed a $10 million lawsuit against Grant and the company, alleging battery, assault, negligence, and intentional infliction of emotional distress. Voyles claimed that Grant pursued him and told him, ‘You’re going to die,’ before firing at close range.
Grant, an Army veteran, disputed these allegations, testifying that he fired his weapon to protect himself after Voyles appeared aggressive and ready to attack with bolt cutters. Law enforcement did not charge Grant following the incident, and Voyles previously pleaded guilty to burglary of a dwelling.
Following a seven-day trial, a Portland jury rejected the lawsuit. The jury found that Voyles’ decision to break into the business was a “substantial factor” in his injuries, siding 10-2 with the business owner.
