Romanian pension law 360/2023 outlines specific regulations regarding survivor benefits and eligibility requirements. For spouses, survivor pensions are not automatically transferred; beneficiaries must apply through local county pension funds. The benefit amount is calculated as a percentage of the deceased’s entitlement based on the number of beneficiaries, ranging from 50% for a single spouse to 100% for three or more beneficiaries. To receive a lifelong pension, a spouse must have reached legal retirement age and been married to the deceased for at least 15 years, with reductions applied for shorter marriages. Additionally, the law extends survivor pension eligibility to children who are continuing their studies in organized educational programs, provided they do not exceed the age of 26. To maintain these benefits, students over the age of 16 must submit original enrollment certificates to territorial pension houses, typically within 10 calendar days of the start of the academic year. Failure to provide this documentation can lead to the suspension of payments starting November 1. Regarding administrative disputes, the National House of Public Pensions (CNPP) stipulates that individuals who believe their pension amount is incorrect due to errors in calculating work seniority, special conditions, or average annual points have 45 days from the official communication of a decision to file a contestation. Furthermore, pensioners living abroad are required to submit a life certificate twice a year; the upcoming deadline for this requirement is September 30.
