Samsung Electronics America and CMA CGM shipping dispute

Overview

Samsung Electronics America has filed a complaint with the United States Federal Maritime Commission (FMC) against the French shipping company CMA CGM, seeking at least $186 million in damages.

The dispute concerns logistics failures and container charges occurring between 2020 and 2023 during pandemic-era supply chain disruptions. Samsung alleges that under “store door” shipping contracts, CMA CGM failed to fulfill obligations to move containers from overseas factories through U.S. ports to inland destinations due to port congestion, chassis shortages, and trucking issues.

Samsung claims it was forced to pay for over 121,000 instances of demurrage, detention, and rail storage fees despite these failures. The complaint notes extreme costs, such as a single rail shipment storage fee exceeding $160,000. Additionally, Samsung accuses CMA CGM of unilaterally converting prepaid “store door” shipments into “container yard” (CY) moves, which effectively shifted the responsibility for inland transport back to Samsung.
