Schufa credit scoring and transparency developments in Germany

The German credit agency Schufa has undergone significant changes regarding its scoring methodology and legal standing. In March 2026, the agency transitioned to a new scoring system using a 100 to 999 point scale, replacing the previous percentage-based model. Schufa disclosed twelve specific criteria for these scores, including payment history, the age of bank and credit card contracts, and the duration of current residency. This shift has impacted consumer scores, with approximately 8 percent of individuals seeing a decrease and 9 percent seeing an improvement. Concurrently, the German Federal Court of Justice (BGH) issued a ruling concerning transparency and consumer rights under the GDPR. The court overturned previous rulings and sent cases back for new hearings, clarifying that consumers may claim detailed information about automated scoring logic if a score was a decisive factor in a contract rejection. To assist consumers, the BGH established a legal presumption that a score was decisive if a company rejects a customer shortly after requesting it. Further regulatory changes are set to take effect on November 20, 2026, mandating greater transparency. Credit agencies will be required to explain which data points influence scores and how they are weighted, helping individuals—such as those recovering from private insolvency—verify if outdated information is affecting their standing. Additionally, new regulations for installment purchases will take effect in November, requiring ‘buy now, pay later’ providers, including those offering micro-loans up to 200 euros, to perform more rigorous checks on a consumer’s ability to repay to prevent debt traps.
