Slovak Civil Code legislative reform

Overview

Slovakia has moved to overhaul its private law by replacing the 1964 Civil Code, which Justice Minister Boris Susko described as a “mosaic of layers” that is outdated for modern market conditions.

Initially, the proposal was presented to the National Council for its second reading. The draft aimed to unify civil and commercial obligation law and introduce new regulations for inheritance contracts, real burdens, and the status of vulnerable persons. During the proposal stage, opposition members and legal groups like Via Iuris expressed concerns, with the latter requesting a delay of the effective date.

Following the proposal, the Slovak Parliament approved the overhaul with 90 votes in favor, zero against, and 52 abstentions. The new legislation introduces a unified three-year general statute of limitations, expanded inheritance options, and the concept of “spoločné imanie manželov” (common property of spouses). The reform now awaits the signature of President Peter Pellegrini and is scheduled to take effect on July 1, 2027.
