Spain flood risk regulation debate

The Spanish government, through the Ministry for the Ecological Transition, is developing a royal decree to tighten construction regulations in flood-prone areas following extreme weather events like the DANA in Valencia. The proposal seeks to restrict both private and public developments in high-risk zones, including banning new residential uses, prohibiting the transformation of certain rural lands, and forbidding the construction of basements or underground garages in floodable areas. Sensitive facilities such as schools, hospitals, and elderly care centers are also targeted.

Industry representatives, specifically the Association of Real Estate Developers of Madrid (Asprima), have warned that the decree effectively converts technical flood mapping into urban planning regulations without established procedures for approval, review, or appeal. Critics highlight the potential for legal uncertainty affecting approximately 33,000 hectares of built-up land, including 3,600 hectares of residential areas. In regions like Asturias, experts note that the shift from allowing risk-reduction measures to outright shielding areas from new construction could block renovations, property replacements, and ongoing projects.

Under the proposed regulations, municipalities will be required to align their urban planning with official flood zone maps. Local councils will have a five-year window to update their urban development plans to reflect these maps. If municipalities fail to comply, the Hydrographic Confederation will issue unfavorable reports on any new development projects within those plans, a measure expected to significantly impact urban planning in regions where official cartography identifies major flood risks in urban centers.
