Spain internship regulation and compliance issues
Overview
The Spanish government, through Minister of Labour and Social Economy Yolanda Díaz, proposed new regulations to increase oversight and responsibilities for businesses employing interns. The draft regulation, developed following agreements with labor unions, aims to require companies to compensate interns for expenses such as travel costs in addition to social security contributions.
Concurrently, the State Body for Labor Inspection and Social Security opened an investigation into the Generalitat de Catalunya’s Department of Culture. The probe examines 207 individuals who allegedly performed structural, non-formative tasks as interns between October 2024 and July 2026. Investigators report these individuals received monthly stipends of 1,250 euros, leading the Social Security Treasury to request 2.16 million euros in unpaid contributions. The Department of Culture has challenged these findings, maintaining the internships were formative, and has paused its internship program for the 2026/2027 period pending legal processes.
