Spain widowhood pension regulatory changes

Overview

The Spanish government has implemented changes to widowhood pension requirements through Royal Decree-Law 31/2026. The reform specifically targets common-law couples who shared children but had not formally registered their relationship or married.

Under the new regulations, applicants can qualify for benefits by demonstrating at least two years of uninterrupted coexistence immediately preceding the death. This must be substantiated through documentation such as a census registration certificate (empadronamiento), as having children in common alone is no longer sufficient to secure the pension.

The modification also includes provisions for retroactive claims, allowing for pension applications in cases where the death occurred before the reform took effect, provided the application is submitted within an extraordinary twelve-month period.
