Spanish Supreme Court rulings on ACS group projects

Overview

The Spanish Supreme Court has issued several rulings involving projects linked to the ACS group.

In one decision, the court upheld a requirement for Escal UGS to return approximately €209.7 million. This follows the shutdown of the Castor underwater gas storage project due to seismic activity. The reimbursement was demanded by the National Commission on Markets and Competition (CNMC) after the Constitutional Court declared provisions of a 2014 royal decree, which had provided compensation to project promoters, to be unconstitutional.

In a separate ruling, the court annulled the government’s previous calculations regarding compensation for the rescue of the R-2 highway in Madrid. The court invalidated provisional settlements that had concluded no payment was owed to the concessionaire Henarsa, a company with participation from ACS. The court has ordered the Ministry of Transport and Sustainable Mobility to determine the definitive compensation amount ‘without further delay’ for the highway, which the State has managed since March 2018.
