The Bombay High Court’s Goa bench convicted former Tehelka editor-in-chief Tarun Tejpal for a 2013 sexual assault involving a junior colleague. Overturning a previous acquittal, the court sentenced Tejpal to ten years of rigorous imprisonment and imposed a fine. Tejpal, who maintains he is a political victim, indicated he would appeal the decision to the Supreme Court. Following the legal development, filmmaker Vishal Bhardwaj announced plans to develop a feature film inspired by the high-profile case. Bhardwaj intends to use a “Rashomon-style” narrative to explore multiple conflicting perspectives, examining the contrast between the initial acquittal and the subsequent conviction. In its reversal of the Mapusa trial court’s decision, the High Court condemned the lower court’s reliance on misogynistic assumptions and the “ideal victim” construct. The High Court criticized the previous judgment for questioning the survivor’s credibility based on her composure and for permitting invasive cross-examinations into her sexual history and private messages. Finding the survivor’s evidence to be of “sterling quality,” the High Court ruled that Tejpal’s email apologies for a “shameful lapse of judgment” constituted valid evidence. Recently, the Goa government filed an appeal with the Supreme Court seeking to increase the sentence, arguing the 10-year term is “grossly disproportionate to the nature and gravity of the offences” and requesting life imprisonment. In a recent development, the Supreme Court rejected a plea by Tejpal seeking exemption from surrendering.
