Texas lawsuit against Nestlé and Gerber over baby food
Overview
Texas Attorney General Ken Paxton has filed a lawsuit against Gerber Products Company and its parent company, Nestlé USA, alleging the companies misled consumers regarding the safety of their baby food products under the Texas Deceptive Trade Practices Act.
The legal action claims that between 2017 and 2019, Gerber used ingredients with heavy metal concentrations significantly exceeding federal limits for bottled water. Specifically, the state alleges that 67 batches of rice flour contained arsenic at levels more than nine times the limit, carrots contained cadmium at 17 times the limit, and sweet potatoes contained lead at nearly 10 times the limit. The lawsuit also asserts that the company performed infrequent testing for mercury and often tested individual ingredients rather than the finished products.
Gerber has disputed these allegations, maintaining that its products meet FDA limits and that its safety standards often exceed federal requirements.
