Following the launch of the Truth API on 1 August, Trump Media & Technology Group (TMTG) has expanded its client base, securing more than ten customers—primarily high-frequency trading firms—with monthly fees ranging from $60,000 to $100,000. The service provides real-time, low-latency access to posts from ten high-profile accounts, including those of President Donald Trump, Vice President JD Vance, and the White House. This has triggered legal and regulatory scrutiny. U.S. Senators Elizabeth Warren, Adam Schiff, and Mark Warner have requested an SEC investigation into potential violations of securities laws, with critics describing the arrangement as ‘corruption’ and ‘insider-trading-like.’ In response to the controversy, Senator Alex Padilla introduced the Stop Corrupt Trading Act (S. 5221) to prohibit a president or vice-president from profiting from advance access to their own statements. In a federal lawsuit filed in Manhattan, The Intercept and the Freedom of the Press Foundation have challenged the service, describing it as ‘extraordinary, corrupt, and unconstitutional.’ The plaintiffs argue that monetizing presidential announcements regarding military operations, tariffs, and appointments violates First Amendment rights to equal access to official information and Fifth Amendment protections. They contend that providing millisecond-level advantages to paying clients allows for the exploitation of market-moving government information for personal enrichment, noting that Trump holds approximately 41.3 percent of TMTG. The lawsuit also names White House officials Daniel Scavino and Natalie Harp as defendants and seeks to shut down the API service.
