In Turkey, changes to the Ministry of National Education’s scoring system for administrative appointments have led to unrest among educators. Following a shift that prioritizes total years of teaching service alongside administrative experience, many newly appointed assistant principals have requested the cancellation of their appointment decrees. These teachers cited the high workload of large student populations and difficulties adapting to digital administrative systems like e-Okul as primary reasons for their requests. Parallel to these appointment disputes, legal challenges have emerged regarding staff in special program and project schools. Administrative courts in Ankara, Tokat, and Kayseri have ruled against the Ministry’s discretionary power regarding the extension of four-year terms for teachers and administrators. The judiciary determined that decisions must be based on “concrete, objective, and verifiable criteria” and the principle of merit. Following these rulings, which overturned decisions lacking documented success criteria, affected teachers may be able to return to their previous schools. Expanding on these legal precedents, the Ankara 5th Administrative Court has issued a stay of execution regarding teacher appointments and term extensions in project schools. This ruling, initiated following concerns raised by Türk Eğitim-Sen, centered on the rejection of a teacher's application for reappointment after their term expired. The court emphasized that the administration's discretionary power is not absolute and must remain within legal limits, noting that existing success criteria were not sufficiently clear. This decision suggests the Ministry may be required to implement more transparent and measurable standards in future appointment guides to ensure legal certainty.
