Turkish military judicial and disciplinary disputes

Legal disputes involving military personnel and judicial rulings in Turkey have emerged in recent developments.

In one long-standing case, the Council of State overturned a 2010 military exam ruling regarding the Gendarmerie General Command. The original decision, which had rejected claims of irregularities in the transition from non-commissioned officer to officer, was revisited after it was revealed that members of the previous military court panel had links to FETO/PDY. Following a retrial, the Council annulled the original results, leading to the appointment of three former non-commissioned officers to the rank of lieutenant.

Separately, five lieutenants dismissed from the Turkish Armed Forces following a graduation ceremony in August 2024 are facing judicial investigation. The officers were expelled after chanting slogans such as “We are the soldiers of Mustafa Kemal”. While the officers' lawyers allege that the dismissal vote was influenced by pressure from the Land Forces Commander, members of the High Disciplinary Board who voted for the dismissal have filed criminal complaints against the lieutenants, accusing them of “public insult due to official duty” and “serial slander”.
