UK-Apple encryption and data access dispute

A legal and diplomatic dispute has emerged between the United Kingdom and Apple regarding government access to encrypted data. The conflict stems from a Technical Capability Notice issued by the UK Home Office under the Investigatory Powers Act, which seeks a mechanism to access encrypted iCloud backups. In response to these demands, Apple withdrew its Advanced Data Protection feature for all users within the United Kingdom.

The situation has escalated into a challenge against the UK’s Investigatory Powers Tribunal (IPT) due to its policy of secrecy. Lawyers representing Apple and civil rights groups, such as Privacy International and Liberty, have criticized the government’s refusal to confirm or deny the existence of these notices, describing the secrecy as ‘farcical’ and ‘logically unsustainable.’ While the UK government argues that disclosure poses a national security risk by assisting ‘hostile actors,’ critics contend the policy undermines open justice.

Simultaneously, the dispute has drawn international political attention. A bipartisan group of US lawmakers, including Senator Ron Wyden and Representative Warren Davidson, issued a joint letter to the IPT. They argued that the use of secrecy directives unnecessarily strains US-UK relations and prevents the US Congress from exercising its constitutional legislative oversight, asserting that a foreign executive body should not be permitted to frustrate the powers of the US government through administrative gag orders.
