The UK Financial Conduct Authority (FCA) has released final guidance, via Policy Statement PS26/18, to establish a regulatory perimeter for cryptoassets under the Financial Services and Markets Act 2000. This framework operates on the principle of ‘same risk, same regulatory outcome’ and categorizes various digital assets, including qualifying stablecoins and specified investment cryptoassets. The regime covers activities such as issuing stablecoins, operating trading platforms, and arranging staking. While the full regime is scheduled to take effect on 25 October 2027, an application window for businesses opens on 30 September 2026. Firms are encouraged to apply by 28 February 2027 to maintain operational continuity, as existing registrations under previous frameworks, such as Money Laundering Regulations, will not automatically convert to FSMA permissions. Despite this increased oversight, the new regime does not mandate that banks facilitate cryptocurrency-related transactions. Currently, many large UK retail banks maintain restrictions or outright blocks on crypto payments, meaning consumer access to authorized exchanges may still be subject to individual bank policies. In parallel developments, the FCA and Bank of England are exploring the tokenization of assets, specifically considering frameworks for tokenized gold and commodities to improve collateral mobility in wholesale markets. Additionally, HM Treasury has drafted amendments intended to exempt certain UK-issued stablecoin payments from specific dealing and arranging requirements to streamline digital finance operations.
