UK industrial accident legal penalties

Overview

UK companies have received significant fines following industrial accidents that resulted in severe injury and death.

Factory Services UK Limited was fined £160,000 after a maintenance engineer suffered life-changing injuries at a Merseyside site when his arm was pulled into moving machinery. An investigation by the Health and Safety Executive (HSE) found that a hole in the casing had existed for years to allow workers to clear blockages without stopping the machine.

In a separate incident in Surrey, contractors Appledorn Developments and T Vaughan were fined over £1 million following the death of Gheorghita Arsene. Mr. Arsene was killed when an unsupported trench collapsed while he was replacing a pipe. The HSE investigation determined that no supports were in place and excavated soil had been placed too close to the trench edge. A site manager from T Vaughan received a suspended prison sentence for failing to implement safety measures despite being aware of the risks.
