UOKiK fine against Procam for unfair agricultural contracts

Overview

The President of the Office of Competition and Consumer Protection (UOKiK) imposed a fine exceeding one million PLN on the company Procam due to unfair contractual practices involving agricultural producers.

Investigations determined that Procam used its contractual advantage to shift weather-related risks entirely onto farmers. The company’s contract templates required the delivery of full quantities of crops—including rapeseed, barley, oats, wheat, and rye—even if harvests were destroyed by uncontrollable factors such as drought, frost, or hail.

Regulators noted that Procam’s definition of force majeure excluded common weather events, instead limiting such protections to occurrences like war, hurricanes, or strikes. Furthermore, the company required farmers to provide notice of such events within a two-day window, which was deemed an unreasonably short timeframe.

Procam cooperated with authorities and voluntarily submitted to the financial penalty. The company has implemented new contract templates as of June 2026.
