US aviation mental health legislation

Overview

The US Senate has passed two bipartisan bills aimed at modernizing mental health regulations for pilots and air traffic controllers. The legislation, including the John A. Hauser Mental Health in Aviation Act and the Aviation Medication Transparency Act, seeks to address a ‘culture of silence’ where professionals may conceal mental health conditions or medication use due to fear of losing their professional licenses.

The John A. Hauser Act requires the FAA to update medical-certification regulations within 18 months to encourage early disclosure and treatment. It also authorizes up to $15 million annually between fiscal years 2026 and 2028 to expand medical-review capacity, recruit examiners, and reduce certification backlogs.

Complementing this, the Aviation Medication Transparency Act focuses on providing clearer guidance regarding approved medications to prevent professionals from unknowingly jeopardizing their employment. Both measures must now move to the US House of Representatives before they can be sent to the president for signature.
