Overview

The U.S. Court of Appeals for the District of Columbia Circuit has ruled against a data-sharing agreement between the Internal Revenue Service (IRS) and U.S. Immigration and Customs Enforcement (ICE). The court upheld an injunction to prevent the IRS from sharing mass taxpayer information, such as addresses and income data, with immigration authorities.

The ruling found that the procedures used to fulfill ICE requests violated Section 6103 of the Internal Revenue Code, which is designed to protect taxpayer confidentiality. Judge Cornelia Pillard noted that the processes adopted under the Trump administration “violated federal law in numerous ways” by automating the review of millions of records without individual verification or specific, legitimate reasons for each request.

Before the court intervened, ICE had requested the last known addresses of approximately 1.28 million individuals, and the IRS had already disclosed records for roughly 47,000 taxpayers. An audit by the Treasury Inspector General for Tax Administration (TIGTA) had previously identified errors in how individuals were identified on these lists.
