US Department of Education dispute with ABA

The U.S. Department of Education has recommended revoking the American Bar Association’s (ABA) authority to accredit law schools, citing a lack of independence between its role as a professional advocacy group and its role as an accreditor. Administration officials have characterized the current system as a “cartel” that allows for the injection of political preferences and progressive ideologies into the accreditation process.

Specific criticisms focus on the ABA’s promotion of diversity, equity, and inclusion (DEI) initiatives. The administration has raised concerns that the ABA’s requirements for law schools to demonstrate “concrete” efforts toward diversity may conflict with current legal interpretations of nondiscrimination. This scrutiny follows legal challenges regarding race-based admissions and allegations that certain institutional policies, such as those at the City University of New York (CUNY) School of Law, may violate academic freedom.

In response to these pressures, the ABA’s Accreditation Council voted 10-6 to repeal Standard 206, which previously mandated that law schools demonstrate concrete actions toward diversity and inclusion among students, faculty, and staff to maintain accreditation. This decision follows an April 2025 executive order from President Trump directing Education Secretary Linda McMahon to evaluate the council’s status. The repeal also follows advocacy from groups like the Equal Protection Project and the legal precedent set by the 2023 Supreme Court ruling in Students for Fair Admissions v. Harvard. While the ABA maintains its oversight of nearly 200 programs, the regulatory shift marks a significant change in how legal education standards are applied.
