This redefinition effectively excludes accidental deaths resulting from lawful economic activities—including commercial fishing, logging, or industrial development—from federal prosecution. The administration maintains these changes return the law to its original intent, citing a 2024 Supreme Court decision regarding federal agency authority. Environmental advocacy groups and former wildlife officials have criticized these moves, the move, arguing they undermine essential protections it creates a ‘massive loophole’ that relieves industries of responsibility for the foreseeable consequences of their actions on imperiled species.
