The U.S. Environmental Protection Agency (EPA) has finalized the repeal of most of the Biden administration’s 2024 Carbon Pollution Standards for greenhouse gas emissions from coal and gas-fired power plants. Administrator Lee Zeldin announced the rule, asserting that the previous standards exceeded Clean Air Act authority by relying on unproven carbon-capture technology and ignoring the Supreme Court’s 2022 ruling in West Virginia v. EPA. The final rule, scheduled to take effect on November 16, eliminates standards for existing fossil-fuel-fired steam units and several carbon-capture requirements for coal plants and new baseload combustion turbines. The EPA projects the repeal will save taxpayers approximately $310 billion through 2047, aiming to lower electricity prices and allow generators to prioritize grid stability and reliability. Following the announcement, the repeal has faced immediate legal challenges from organizations including the Natural Resources Defense Council and the American Public Health Association, which argue the move threatens public health and the environment. Academic communities, such as those at Georgetown University, have characterized the decision as a “major retreat from federal climate regulation.” In Georgia, clean energy advocates warned that the policy shift could more than double emissions from new natural gas turbines being built to meet data center demand. Consequently, Georgia Power has already adjusted its plans to postpone the retirement of certain coal units. Legal opposition has intensified as a coalition of twenty-one states, led by New York, joined by the District of Columbia and several major cities including Chicago and Denver, filed a lawsuit to strike down the repeal. The plaintiffs are petitioning the U.S. Court of Appeals for the District of Columbia, alleging the EPA unlawfully abandoned pollution limits without considering reasonable alternatives and that dismantling protections will worsen the climate crisis. Under the Trump administration, the EPA has expanded its regulatory rollbacks.
