US federal court rulings on HUD funding restructuring

Federal courts have issued rulings blocking recent attempts by the U.S. Department of Housing and Urban Development (HUD) to restructure various housing-related funding programs.

In one instance, a federal judge blocked a plan to limit funding for permanent supportive housing. The ruling favored a multistate lawsuit, preventing HUD from enforcing a $1.3 billion set-aside that would have prioritized transitional housing models over the established ‘Housing First’ approach. Advocates argued the shift threatened the stability of approximately 97,000 residents.

Separately, a judge in Massachusetts issued a temporary restraining order against HUD’s plan to overhaul the Fair Housing Initiatives Program (FHIP). The court found that HUD failed to provide a reasoned explanation for redirecting $56 million in congressional funding away from over 100 community-based nonprofits toward just five larger awards. The order requires HUD to maintain the previous year’s funding structure while legal proceedings continue.
