U.S. federal tax refund fraud prosecutions

Overview

Federal authorities have brought indictments against multiple individuals involved in large-scale tax refund fraud schemes targeting the U.S. Treasury.

In one case originating in Idaho, a superseding indictment expanded a multistate conspiracy to include seven defendants across Idaho, Illinois, Florida, California, and Georgia. Prosecutors allege the group used false individual and trust tax returns, along with fictitious financial instruments, to attempt to obtain more than $57 million in refunds between 2023 and 2024. Over $8 million was successfully obtained.

In a separate federal indictment, three Mexican citizens residing in the Atlanta area were charged for an alleged scheme operating from 2019 through 2026. The defendants are accused of using third-party Mexican identification documents to obtain Individual Taxpayer Identification Numbers (ITINs) to secure fraudulent refunds. This scheme allegedly resulted in more than $74 million being diverted through a check-cashing business via over 16,000 cashed checks.
