Conversely, the Department of Justice’s Office of Legal Counsel (OLC) issued an opinion stating that federal prohibitions on handgun sales to 18-to-20-year-olds are unconstitutional. The OLC concluded that these individuals are part of ‘the people’ protected by the Second Amendment, noting they participate in the political community through voting and jury service. The opinion argued that existing federal statutes are inconsistent with Supreme Court precedents and found no historical tradition from the Founding era to justify such restrictions. Following this legal finding, the Department of Justice announced it will no longer seek to impose criminal penalties on licensed dealers who sell handguns to law-abiding adults within the 18-to-20 age group. While the underlying federal statutes remain in effect, the administration indicated it will not defend or prosecute cases under these specific provisions. This decision has drawn criticism from gun control organizations, such as GIFFORDS, which characterized the move as an effort to ‘please the gun lobby.’
